iKonica Art Gallery by Andrea Colombo (hereinafter referred to as iKonica Art Gallery) is authorized to sell artworks to users visiting the website.

These terms govern the sale and supply of artworks from iKonica Art Gallery to the user. By placing an order on the website https://www.ikonica.eu, the user declares to have read and accepted the terms and conditions of sale described below. iKonica Art Gallery reserves the right to amend these terms in the future.

ARTWORKS
The artworks offered for sale by iKonica Art Gallery are those described and displayed on the Website, within the limits of stock availability. Artworks sold via www.ikonica.eu are subject to changes based on availability. iKonica Art Gallery may change the quantity or type of artworks at any time, but is obliged to promptly inform the user if one or more artworks in the order are no longer in stock.
Artworks selected by the user remain the property of iKonica Art Gallery until full payment has been received.

PRICES
The price of the artworks is shown in Euros and includes all applicable taxes, excluding shipping costs and any import duties in the destination country.
In case of pricing errors on one or more artworks, iKonica Art Gallery reserves the right to amend and/or cancel the order, offering the user the option to purchase the artworks at the correct price.

BROWSING THE WEBSITE & ORDER PROCESS
Users can freely browse all website pages without any purchase obligation.

From the available artworks on www.ikonica.eu, users can select an artwork and add it to their cart. Selected artworks are temporarily saved. By clicking on “Cart” (under the Store menu), the user can proceed to purchase. Users will be prompted to log in if they’ve previously ordered, or create a new account.

Once logged in, the user can choose the delivery address, payment method, and provide payment details.
Order details are summarized in an “order summary” before confirmation. Users must review and correct the data if necessary before completing the order by clicking Check-out, thus submitting the data to iKonica Art Gallery. Clicking the “Place Order” button constitutes a binding offer by the customer for the selected artworks.

ORDER CONFIRMATION
Upon receiving the order, iKonica Art Gallery will send an email to the address provided by the user confirming receipt and summarizing the order (“Order Confirmation”). This confirmation does not constitute approval of the purchase. If iKonica Art Gallery decides not to approve the order or contract, the customer will be informed immediately via email.

PAYMENT METHODS
Your purchase is processed in complete security.
We use PayPal as our payment gateway, which handles both credit card and PayPal account payments.

Your payment data is transmitted over a secure SSL (Secure Socket Layer) encrypted connection directly to the payment platform. Therefore, at no point during the purchase process does iKonica Art Gallery have access to or store your credit card information.

You can pay for your order using a credit or debit card (Visa, MasterCard, American Express) or via PayPal. We also accept bank transfers.
Cash on delivery is not accepted at this time.

INVOICING
Invoice payments are possible upon request via email, which must be sent at the time of purchase.
Invoice requests must include all necessary details: name, surname, address, VAT number, Tax Code, recipient code, and email address.

SHIPPING METHODS
To ensure timely and accurate delivery, iKonica Art Gallery ships exclusively via express courier.
Orders are prepared within 72 hours from order confirmation. If unexpected issues occur during fulfillment (delays, out-of-stock items, etc.), customers will be notified via email.

Shipping costs are:
– Italy: € 75,00
– EU countries € 150,00
– Non-EU countries: € 300,00.
Shipping rates may be changed in the future.

RIGHT OF WITHDRAWAL (RETURNS POLICY)
If for any reason the customer is not satisfied with the artwork received, they may return it for a full refund. The return right must be exercised within 14 days of delivery.

In case of issues, customers are asked to email info@ikonica.eu.

To return the item, customers must use the original packaging, write the reason for return on the back of the delivery note, and ship the artwork to: iKonica Art Gallery di Andrea Colombo, via N.A. Porpora, 16/A – 20131 Milano (MI), Italy.

The artwork must not be damaged or altered and must be returned in its original packaging, complete with all parts, including packing materials and documentation. By law, return shipping costs are the customer’s responsibility. The customer is fully responsible for the return shipment until it reaches our warehouse.

We strongly recommend using an express courier or registered mail. In case of damage during transport, iKonica Art Gallery will notify the customer within 5 business days of receiving the item, allowing them to file a claim with the courier; iKonica Art Gallery is not responsible for damage or loss during non-insured return shipments.

If the original shipment was discounted and the remaining total after the return no longer qualifies for free shipping, the cost of the original shipping will be deducted from the refund.

Regardless of the refund method, any discount applied through coupon codes may be partially or fully deducted from the refund.

iKonica Art Gallery reserves the right to cancel and refund all or part of the customer’s purchase without needing to provide a reason.

The right of withdrawal must be exercised by sending an email within 14 business days from the date of delivery.

Refunds will be processed within 14 days of receiving the returned artwork, via reversal to the original payment method. The right to withdrawal will be void if the artwork is not returned in its original condition, including:
– Absence of original packaging;
– Missing components/accessories;
– Damage not caused by transport.

If the right of withdrawal is voided, the artwork will be returned to the sender, and shipping costs will be charged to them.
If the original order qualified for free shipping, and the remaining order value after return no longer qualifies, the shipping cost will be deducted from the refund.

PRIVACY POLICY
In compliance with Regulation (EU) 2016/679 (GDPR), iKonica Art Gallery by Andrea Colombo, based at via N.A. Porpora, 16/A – 20131 Milano (MI), informs users that personal data collected through order forms will be processed for purposes related to order fulfillment, customer relationship management, and general business activities.

Processing may be carried out via paper records, digital tools, or telecommunication systems.

Customers may exercise their rights at any time under Articles 16 and following of the GDPR —such as accessing, modifying, deleting, or objecting to the use of their data for marketing— by writing to the Data Controller: iKonica Art Gallery di Andrea Colombo, con sede in via N.A. Porpora, 16/A – 20131 Milano (MI).

EXCLUSIONS
iKonica Art Gallery is not liable for full or partial non-fulfillment or delays in fulfilling its obligations under this contract due to events that cannot be prevented (Force Majeure).

Force Majeure events may include, but are not limited to: wars, riots, uprisings, major internet security breaches, technical failures, unauthorized access and/or intrusions into website servers, strikes of any kind, telecommunications failures.

INVALIDITY OF TERMS
If one or more clauses of these General Terms of Sale are deemed invalid by law, regulation, or final court ruling, the remaining clauses shall remain fully valid.

APPLICABLE LAW & JURISDICTION
These General Terms of Sale and all contractual relationships between iKonica Art Gallery and the customer are governed by Italian law. Any dispute regarding the interpretation and/or execution of this contract shall be under the exclusive jurisdiction of the Court of Milan.
